Nod to Registering Homes Through GPA 

RELIEF The high court had struck down a state govt circular restricting transactions through general power of attorney

Thousands of property owners in the city can heave a sigh of relief as the Delhi government has decided to allow properties to be registered through general power of attorney (GPA).

On May 5, the Delhi High Court had struck down a circular of the state government, restricting property transaction through GPA in the city.

The law department of the Delhi government, which was asked to study the judgment, has advised the revenue department not to go for an appeal.

“The circular, issued last year by the department, that had banned sale of property on the basis of a GPA, was set aside by the court. We have decided not to go for an appeal, which means it will be allowed from now on,” said Dharam Pal, revenue secretary, Delhi government.

The move will benefit lakhs of Delhi residents and especially those living in co-operative housing societies and Delhi Development Authority flats.

A circular issued by the Delhi government’s revenue department last year had stated: “No transfer of property will take place until a clear sale deed is executed and duly registered by the executants in the office of the registrar/subregistrar.”
